PURCHASE AGREEMENT, TERMS & CONDITIONS
(Hypnotherapy Sessions & Digital Content)

These Terms & Conditions apply to all purchases of Driving Test Confidence products and services provided by FlowMagic Ltd.
By purchasing, accessing, or using any Driving Test Confidence materials or sessions, you (the Client) confirm that you have read, understood, and agreed to these Terms.

2. SCOPE OF THIS AGREEMENT
These Terms apply solely to Driving Test Confidence products and services, which may include:
Live hypnotherapy sessions
Pre-recorded hypnotherapy or relaxation audio
Digital educational or confidence-building materials
Only the products or services explicitly listed on the checkout page at the time of purchase are included.
No purchase includes additional services, support, or access unless clearly stated.
3. NATURE OF THE SERVICE (IMPORTANT)
Driving Test Confidence provides hypnotherapy-based confidence and relaxation support.
It is not medical, psychological, or psychiatric treatment
It does not diagnose, treat, or cure any condition
It is not a replacement for therapy, counselling, or medical care
It is not a replacement for proper driving instruction
All content is provided for general emotional support and personal development purposes only, in line with ASA guidance on non-medical wellbeing services.
4. NOT A SUBSTITUTE FOR DRIVING INSTRUCTION OR THE HIGHWAY CODE
Driving Test Confidence & FlowMagic, Ltd. materials, sessions, and support (including but not limited to Driving Test Confidence, Pass Your Theory Test, RTT® hypnotherapy, coaching calls, meditations, VIP package contents, and written content) are designed to support emotional wellbeing for driving and the driving test. They do not constitute driving lessons, driving instruction, or training in vehicle handling, road skills, or the Highway Code, and are not a substitute for instruction provided by a qualified, licensed driving instructor. The Client remains solely responsible for obtaining appropriate driving instruction and for their own competence and legal compliance behind the wheel.
This programme does not guarantee that you will pass your driving theory test or practical driving test.
You understand that any driving practice should only take place in accordance with UK law and under appropriate supervision where required.
5. SUITABILITY & HIGH-ANXIETY SAFETY NOTICE
Hypnotherapy is not suitable for everyone.
By purchasing, the Client confirms that:
They are not experiencing a condition that would make hypnotherapy unsuitable (including, but not limited to, psychosis, untreated PTSD, epilepsy triggered by relaxation, or severe dissociation), or
They have sought appropriate professional advice before participating
If at any point the Client feels distressed, overwhelmed, or unsafe, they must stop using the materials immediately and seek appropriate support.
6. AGE & PURPOSE CONFIRMATION
By purchasing, the Client confirms that:
They are at least 18 years of age, or
they are the parent or legal guardian of the learner who will be using this programme and have the legal authority to purchase it on their behalf.
If they are purchasing this programme for a person under the age of 18, they acknowledge that they are responsible for supervising their use of the programme and ensuring that it is suitable for their individual needs.
7. CLIENT RESPONSIBILITY & USE CONDITIONS
The Client understands and agrees that:
Participation is voluntary
Results vary between individuals
No specific outcome (including passing a driving test) is promised or guaranteed
They are responsible for how they apply the content
SAFETY RULE (CRITICAL):
The Client must not drive, practice driving, or operate machinery while listening to hypnotherapy recordings, or any Driving Test Confidence or FlowMagic materials, or immediately afterwards, or while using the Calm Confidence Toolkit or Calm Clarity Toolkit. Driving must only take place once fully awake and alert.
8. DIGITAL DELIVERY & ACCESS
Digital materials are delivered electronically via email or online access.
The Client is responsible for:
Having a suitable device and internet connection
Ensuring a quiet, safe, private environment for listening
Technical issues on the Client’s side do not constitute grounds for refunds or replacement access.
9. CONSUMER CANCELLATION RIGHTS (UK LAW)
If the Client is purchasing as a consumer, they have a 14-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 unless:
They request immediate access to digital content or sessions, and
They acknowledge that this waives their right to cancel once delivery begins
This acknowledgement is obtained at checkout.
10. REFUND POLICY
Due to the digital and experiential nature of hypnotherapy services:
No refunds are available once digital access has been provided or a session has taken place
Missed sessions without the required notice (if applicable) are forfeited
Refunds will only be provided where legally required
Nothing in this section affects the Client’s statutory rights.
11. CONFIDENTIALITY
Personal information shared during sessions is treated as confidential.
Confidentiality may be broken only where:
Required by law, or
There is a serious risk of harm to the Client or others
12. INTELLECTUAL PROPERTY
All Driving Test Confidence content is the intellectual property of FlowMagic Ltd.
The Client is granted a personal, non-exclusive, non-transferable licence for personal use only.
The Client may not copy, record, distribute, resell, or share materials in any form.
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
FlowMagic Ltd is not liable for indirect or consequential losses
Liability is limited to the amount paid for the product or service
Nothing limits liability for death or personal injury caused by negligence or fraud
The Client accepts full responsibility for their participation and use of the materials.
14. TERMINATION
FlowMagic Ltd reserves the right to terminate access if these Terms are breached.
The Client may stop using the services at any time, but no refunds will be issued once access has begun.
FlowMagic Ltd reserves the right to immediately terminate this Agreement and refuse further access or service, without refund, if the Client engages in harassment, abuse, sexual harassment, or any other inappropriate, threatening, or offensive conduct towards Molly Murray, FlowMagic Ltd, or any associated staff or representatives, whether during sessions, in written communication, or otherwise. This includes, but is not limited to, unwanted sexual remarks or advances, discriminatory language, intimidation, or abusive conduct. Termination under this clause takes effect immediately upon written notice from FlowMagic Ltd, and the Client forfeits any right to a refund or continued access to materials or sessions.
15. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Scotland.
Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Client and FlowMagic Ltd in relation to Driving Test Confidence.
No verbal statements or prior agreements apply.
ACCEPTANCE
By purchasing Driving Test Confidence, the Client confirms that they:
Have read and understood these Terms
Accept the nature and limits of hypnotherapy
Consent to participate voluntarily
Accept these Terms in full
